Welcome to Tyket!  MyN3 Corporation, d/b/a Tyket (“Tyket,” “we,” “us,” or “our”) is the owner and operator of various websites and mobile apps. This Privacy Policy (“Privacy Policy” or “Policy”) explains the types of personal data we may collect from visitors to our websites – which include www.tyket.com, www.stagewood.com, www.fanatyks.com, www.tyklash.com, www.myn3.com, www.stagewood.org, www.tywood.com, www.stagewoodevents.com, and www.stagewoodconsortium (including both mobile and online versions) (each, a “Site” and collectively, the “Sites”), our related Tyket and Fanatyks mobile apps (each, an “App” and collectively, the “Apps”), and your use of interactive features, widgets, plug-ins, mobile applications, content, downloads and/or other online services that we own and control and that post a link to this Policy, including in the context of any products and services we provide whether online or offline (collectively with our Sites and Apps, our “Services”).  This Policy also describes how we use personal data, the purpose for sharing and recipients of personal data, and your available rights and choices associated with that data.

In some instances, this Policy may be in addition to other terms, conditions, or disclosures that apply to other programs involving our collection of personal data about you (“Additional Terms and Policies”).  To the extent there is a conflict between this Policy and any Additional Terms and Policies, the Additional Terms and Policies will control unless they expressly state otherwise. This Policy does not apply to third-party sites, products, or services, even if they link to our Services, and we encourage you to read the privacy policies of any third-party site with which you choose to interact.

We also encourage you to review our Terms of Service [https://tyket.com/terms-of-service/], to understand how your personal information will be treated as you make full use of our Sites.  Unless otherwise defined in this Privacy Policy, capitalized terms used in this Privacy Policy have the same meanings as in our Terms of Service.

Through your continued use of our Services, you acknowledge the collection, use, and sharing of your personal data as described in this Privacy Policy.  If you object to anything in this Policy, you may cease using the Services and, if applicable, terminate your account.

1. Our Collection of Personal Data

For the purposes of this Privacy Policy, unless otherwise noted, “personal data” means any information that relates to an identified or identifiable individual or household.  Personal data does not include publicly available information or information that has been anonymized, de-identified, or aggregated.

A.   Personal Data You Provide Us

Tyket may collect the following categories of personal data about you that you choose to provide to us when you use the Services:

    • Contact information. You may have the opportunity to provide various contact information, including your first and last name, email address, phone number, address, and hometown, as well as business contact information such as business name, phone number, address, and hours of operation.  We also provide our users the option to share contact information from their address book with us.
    • User profile. As part of your account creation and use of our Services, you will have the opportunity to provide certain information about you and your interests, including your date of birth, gender, entertainment interests, talents, education, income, and location.
    • Posted content. When you use our Services, you will have the opportunity to submit and/or post content for all users, certain users, or individual users.  That content may include personal data provided by you, such as the content of videos that you may upload.
    • Communication information. When you respond to Tyket emails or messages, we may collect your email address, name, and any other personal data you choose to include in the body of your email or responses.  In addition, when you interact with certain Tyket features, we may collect the content of those communications, including recorded messages, videos, or audio.
    • Payments and other transaction-related information. In order to facilitate certain transactions, you may be asked to provide your payment card information, bank account information, and Social Security number.

    B.   Personal Data From Other Users

    Tyket may collect certain personal data about you that is included in content provided by other users in order to enhance your profile and improve the Services that we provide to you and our users.  Personal data may also be included in the address books that our users choose to share with us.

    C.   Personal Data From Third-Party Sources

    We may collect personal data about you from third-party sources, including third party list providers and other third parties to help us provide, improve, and promote the Services.  These third parties collect and provide this personal data to us pursuant to their privacy policies.  We may supplement the information that you provide with information that we obtain from these sources, including both online and offline data providers.

    D.    Personal Data We Automatically Collect

    When you interact with our Services, we may automatically collect data regarding your online behavior, including your header information, referred information, browsing and usage history, Internet Protocol (“IP”) address, device identification number, device and browser information, and geolocation (“Usage Data”). 

    This data is collected using various technologies, including cookies, pixels, and similar tracking technologies, that may be administered by us or by third parties.  Please review our Cookie Policy  for more information regarding the use of these technologies. 

    Our Site uses various analytics tools in order to maintain and improve our web-based services, including Google Analytics.  Google Analytics may automatically collect personal data about you, such as your IP address, in order to track and report website traffic.  Google uses the collected data to monitor and analyze the use of our Services solely for our benefit.  The third party cookies used for Google Analytics may be kept for up to two years.  If you have already consented to the Google Analytics tracker, you can choose to block or delete the Google Analytics tracker by referring to your browser’s settings and instructions.  For more information on Google’s privacy practices, please visit the Google Privacy Terms web page.

    Your browser or device may include “Do Not Track” functionality.  At this time, the Sits do not respond to browser “Do Not Track” signals.

    E.  Anonymized and De-identified Information

    We may create anonymous or de-identified data from personal data by removing data components that make the data personally identifiable to you or through obfuscation or other means.  Our use of anonymized and de-identified data, data which no longer can be used to identify you or any other particular individual, is not subject to this Privacy Policy.

    2. Our Use of Personal Data

    A.  Our Products and Services.

    We use the personal information we collect to provide, maintain and improve our Services.  This includes:

      • To provide you with requested Services;
      • To customize your experience on our Services according to your behavior and preferences, including to provide customized entertainment and offers;
      • To provide you and others with marketing and promotional information that we believe may be of interest to you, whether offered by us or our third-party partners, and to personalize, measure, and improve such offers;
      • To process payments;
      • To facilitate our rewards program and other incentives and promotions we may offer;
      • To evaluate and enable crowdfunding or investments in our Services;
      • To verify your identity before using certain Services;
      • To provide you with customer service and support, and to facilitate other communications that you request or that are required to render Services to you;
      • To perform analytics for new and existing Services;
      • To maintain and improve the quality of our Services;
      • To protect ourselves, you, and others; prevent fraud; and create and maintain a trusted, secure, and reliable online environment; and
      • To comply with our legal obligations; respond to subpoenas, court orders, or legal process; or to establish or exercise our legal rights or defense against legal claims.

      B.  Digital Marketing Communications 

      We may send you promotional email communications about our Services or other products and services that we believe may be of interest to you, invite you to participate in events or promotions, or otherwise communicate with you for marketing purposes, as allowed by applicable law.  For example, when we collect your contact information through your interaction with our Services, we may use that information to follow up with you regarding an event or send you information that you have requested about Tyket.  You may opt out of receiving any, or all, of these communications from us via the unsubscribe link provided in such emails or by following further instructions provided in Your Rights and Choices.

      3. Our Sharing of Personal Data

      We may share your personal data with the trusted third party entities described below:

        • Our service providers, as necessary for them to provide services on our behalf, such as website hosting, payment processing, data analysis, marketing, email delivery, technical support, and customer service. These third parties have access to your personal information only to perform these tasks on our behalf and are obligated not to disclose or use the information for any other purpose. 
        • Our affiliates, both with and among them, for the purposes identified in Section 2 above and in accordance with the circumstances in which you provided your personal data.
        • Our rewards program participants and other business partners in connection with providing or promoting our Services, or providing you with offers about other products, services, events, and promotions that may be of interest to you, including to facilitate our rewards program. This may include sharing personal data with our business partners for their direct marketing purposes.
        • With other users, if you have provided your contact information, video uploads, or other personal data for purposes of being viewed by other users, such as when they perform a search on our Services;
        • Third-party platform advertising. We may share your information with third-party platform providers who assist us in serving advertising regarding the Services to others who may be interested.  We also partner with third parties (such as Facebook and Google) who use cookies and other tracking technologies to serve interest-based advertising and content on their respective third-party platforms that may be based on your preferences, location and/or interests. 
        • In connection with a business transaction, subject to applicable law, in the event of a merger, acquisition, bankruptcy, or other sale or transfer of all or a portion of our assets. If any such transaction occurs, the purchaser will be entitled to use and disclose the personal data collected by us in the same manner that we are able to use it, and the purchaser will assume the rights and obligations regarding personal data as described in this Privacy Policy.
        • For compliance and harm prevention, including to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. We also may provide information in order to investigate, prevent, or take action regarding illegal activities or wrongdoing; to protect the rights, property, or safety of Tyket, its users, and others; to enforce our agreements; or as otherwise required by law.

      4.  Your Rights and Choices

      a.   Marketing Communications

      If you would like to stop receiving a Tyket newsletter or other marketing or promotional messages, notifications, or updates sent via email, you may do so by following the unsubscribe instructions that appear in those email communications.  You may also opt-out of these messages by contacting us.  Please be advised that you may not be able to opt-out of receiving certain service or transactional messages from us.

      b.   Other Rights Regarding Your Data

      For more information on the rights that you may be entitled to regarding your personal data based on your location, please review Sections 10-12 below.

      5.  Cookie Policy

      The Services may use cookies and similar technologies to improve user experience, for performance and analytics, and to improve our content, products, and services.  A “cookie” is a small text file that a web server stores in browser software.  A browser sends cookies to a server when the browser makes a connection to that server (for example, when requesting a web page from the same domain that created the cookie).

      The general purpose of cookies is to remember a browser over time and distinguish one browser instance (or user) from all others.  Some cookies and other technologies may track the personal data users provide when they interact with a site, and may store such personal data.  We use first-party and third-party cookies to ensure that our Services function properly, to understand how individuals use and engage with our Services, to analyze and improve our Services, and to facilitate targeted advertisements across websites and platforms.  For example, we use cookies to help you reset your account password in the event you need to.  We also use third-party cookies to analyze and improve our Services so that we can report on usage activities and trends.

      We use cookies for the following purposes:

        • Necessity. To enable features that are necessary for providing you the services on our Services, such as keeping you signed in, improving security, and preventing and detecting fraud.
        • Preference. To allow us to remember your preferences and identify you when you return to our Services.
        • Analytics. To allow us to understand how our Services are being used, track site performance and content views, and make improvements to the content, products or services.
        • Advertising. To deliver targeted advertising based on your preferences, location, and/or interests across different services and devices and measuring effectiveness of ads.
        • Social Media. To enable the sharing of content from our Services through social networking and other sites.

      Most browsers are initially set up to accept cookies, but you can reset your browser to block or delete all cookies in your browser’s settings using the links provided below.  Please note that if you block essential cookies, certain parts of the Site may not function properly. 

      If you wish to opt out of our sharing of the data that is gathered when you visit our Services, we may present you with various preferences options in a cookie banner upon first accessing our Services.

      In addition, if you wish to opt out of such sharing for purposes of targeted digital advertising, we encourage you to visit the Network Advertising Initiative or the Digital Advertising Alliance’s Self-Regulatory Program for Online Behavioral Advertising for more information about opting out of seeing targeted digital advertisements.  Similarly, you can learn about your options to opt out of mobile app tracking by certain advertising networks through your device settings.  You may also visit these websites for more information on how you can opt back in to the sharing of data.  Please note that Tyket does not maintain this web tracking data in an identifiable manner. 

      Opting out of advertising networks does not necessarily mean that you will not receive advertisements while using our Services or on other websites.

      We do not support Do Not Track functionality.  Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.  You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

      6. Data Security and Retention

      We maintain appropriate technical, administrative and physical safeguards to help protect the security of your personal data against unauthorized access, destruction, loss, alteration, misuse or disclosure.  Your personal data is accessible to only a limited number of personnel who need access to the information to perform their duties.  Please note, however, that no method of transmission over the Internet or method of electronic storage is 100% secure.

      We will retain your personal data only for as long as is necessary for the purposes set out in this Privacy Policy.  We retain and use personal data to the extent necessary for our legitimate business purposes, to comply with our contractual obligations and to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), as well as resolve disputes, and enforce our legal agreements and policies.

      7. International Data Transfers

      We may transfer personal data, including sensitive data, to the United States or other countries from which the personal data was collected for storage, processing, and use by Tyket.  Those countries may have data protection rules that are different from those of your country.  We will take measures to ensure that any such transfers comply with applicable data protection laws and that your personal data remains protected to the standards described in this Privacy Policy.  Personal data transferred to another country may be subject to lawful access requests by courts, law enforcement agencies, or other government authorities in those other countries.  If you are located in the European Economic Area (“EEA”), the United Kingdom (“UK”), or Switzerland, we comply with any applicable laws to provide an adequate level of data protection to the U.S., as described further in Section 11 below.  Where applicable law requires us to ensure that an international data transfer is governed by a data transfer mechanism, we use EU Standard Contractual Clauses with data recipients located outside the EEA or the UK as well as other appropriate measures and safeguards.

      8. Children’s Privacy

      Our Services are not intended for or directed to children.  We do not knowingly collect personal data from individuals under the age of 13 years without parental consent.  No personal data should be submitted to our Services by individuals under the age of thirteen (13).  If we learn we have collected or received personal data from a child under the age of thirteen (13) without parental consent, we will delete that personal data as permitted by law.  If you believe we may have any collected personal data from a child under the age of thirteen (13) without parental consent, please submit a written request via the email to info@tyket.com.

       

      Note to Client:  COPPA does not require you to permit children under age 13 to participate in your general audience website or online service, and you may block children from participating if you so choose. By contrast, you may not block children from participating in a website or online service that is directed to children, even if the website or online service is also directed to users age 13 or older.  If you choose to block children under 13 on your general audience site or service, you should take care to design your age screen in a manner that does not encourage children to falsify their ages to gain access to your site or service. Ask age information in a neutral manner at the point at which you invite visitors to provide personal information or to create a user ID. In designing a neutral age-screening mechanism, you should consider:

        • Making sure the data entry point allows users to enter their age accurately. An example of a neutral age-screen would be a system that allows a user freely to enter month and year of birth. A site that includes a drop-down menu that only permits users to enter birth years making them 13 or older would not be considered a neutral age-screening mechanism since children cannot enter their correct ages on that site.
        • Avoiding encouraging children to falsify their age information, for example, by stating that visitors under 13 cannot participate or should ask their parents before participating. In addition, simply including a check box stating, “I am over 12 years old” would not be considered a neutral age-screening mechanism.

      In addition, consistent with long standing FTC advice, FTC staff recommends using a cookie to prevent children from back-buttoning to enter a different age. Note that if you ask participants to enter age information, and then you fail either to screen out children under age 13 or to obtain their parents’ consent to collecting these children’s personal information, you may be liable for violating COPPA.

      9. Links to Other Sites

      Our Services may contain links or otherwise provide access to other third-party sites, which may include websites, mobile applications, or Internet locations.  Please note that we have no control over and are not responsible for third-party sites, their content, or any products or services available through the third-party sites.  Our Privacy Policy does not apply to third-party sites.  We encourage you to read the privacy policies of any third-party sites with which you choose to interact.

      10. California Privacy Notice

      This California Privacy Notice applies to any California residents about whom we have collected personal information from any source, including through your use of our Services.  We provide this California Privacy Notice to comply with applicable privacy laws, including the California Consumer Privacy Act of 2018 (“CCPA”).  Any capitalized term used and not otherwise defined below has the meaning assigned to it elsewhere in this Privacy Policy.

      The CCPA provides California residents with rights to receive certain disclosures regarding the collection, use, and sharing of personal information, as well as rights to access, delete, and restrict the sale of certain personal information we collect about them.  California residents also have the right not to receive discriminatory treatment by us for the exercise of your privacy rights under the CCPA.  If you are a California resident, you may submit a request to exercise these righ­­ts by emailing us using the information provided in the Your Privacy Rights Section below. 

      If you are a visually-impaired customer, a customer who has another disability or a customer who seek support in other language, you may access this California Privacy Notice by emailing us at info@Tyket.com.

      A.  Personal Information We Collect

      For the purposes of this California Privacy Notice, “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California consumer/resident or household.  Personal information does not include publicly available information, information that has been de-identified or aggregated, or other information covered by certain sector-specific privacy laws.

      Tyket may collect, or has collected, the following categories of personal information about you over the last twelve (12) months:

      • Identifiers, which includes your first and last name; email address; phone number; address; Social Security number and/or other government-issued identification card number; account username and password; online identifiers as detailed below including IP address or device IDs; and/or other similar identifiers.
      • Payment and financial information, including your payment card number and related payment card information and bank account information.
      • Commercial information, which includes our Services that you have purchased, obtained, or considered; payment and investment activity; and/or other purchasing or consumer histories, tendencies, and preferences.
      • Information relating to Internet activity or other electronic network activity, which includes the information disclosed in Section 1(d) of this Privacy Policy.
      • Geolocation data, which includes Global Positioning System (“GPS”) data based on your IP address.
      • Audio, electronic, or visual information, which includes uploaded user videos.
      • Information not listed above and related to characteristics protected under California or federal law, which may include gender or gender identity.
      • Inferences drawn from any of the above personal information, which includes profiles reflecting individuals’ preferences, characteristics, and behavior.

      B.  What We Do With Your Personal Information

      Tyket may collect, use, or disclose personal information about you for the purposes detailed in Section 2 of this Privacy Policy.

      C.  Sources of Personal Information

      We may collect personal information from the following categories of sources:

      • From you and our other users, including via our Services, in person, telephone, postal mail, and/or social media
      • From our business partners, including those participating in our rewards program
      • From our affiliates
      • Through our service providers, such as non-affiliated companies who help us provide Services to you

      We may supplement the information described above with information we obtain from other sources, including from both online and offline data providers.

      D.  Who We Share Personal Information With

      We may share the categories of personal information identified in Section 10(a) above to our service providers for one or more business purposes.  We may also share that personal information with our business partners in accordance with our agreements with you and those partners, such as to facilitate our rewards program.  As a result, this sharing does not require the right to opt-out under California law.

      We do not sell your personal information to third parties, including personal information of minors under sixteen (16) years of age.  We do share a limited set of data that is gathered when you visit our Services, such as cookies and pixels, with third parties in order to allow you to see tailored digital advertisements, as further detailed in Sections 1(d), 3, and 5 of this Privacy Policy.  To the extent this online advertising activity is interpreted as included in California’s broad definition of “data sale”, you may use the opt-out tools described in Section 10(e) below.

      In the last twelve (12) months, we have disclosed the following categories of personal information to advertising partners as described above: identifiers; information relating to Internet activity or other electronic network activity; and geolocation data.

      E.  Your Privacy Rights

      If you are a California resident, you have the following rights under applicable California law in relation to your personal information, subject to certain exceptions:

      • Right to Know. You have the right to, up to twice in a twelve (12)-month period, request what personal information we collect, use, disclose, and/or sell, as applicable.
      • Right to Delete. You have the right to request under certain circumstances the deletion of your personal information that is collected by us.
      • Right to Opt-Out of Sale. You have the right to opt-out of the sale of your personal information by a business.  However, we do not sell personal information.
      • Right to Non-Discrimination. You have the right not to receive discriminatory treatment for the exercise of the privacy rights described above. 

      How to submit a request.  You may exercise any of the rights described in this section by emailing us at info@stagewood.com.

      Any request you submit to us is subject to an identification and residency verification process (“Verifiable Consumer Request”) as permitted by the CCPA.  We will not fulfill your request unless you have provided sufficient information that enables us to reasonably verify that you are the consumer about whom we collected the personal information on.  In order to verify you, you must provide us with your [first and last name, phone number, and email address].  These rights are also subject to various exclusions and exceptions under applicable laws. 

      You may also designate an authorized agent, in writing or through a power of attorney, to request to exercise the above rights on your behalf.  The authorized agent may submit a request to exercise these rights by emailing the letter of authorization or power of attorney to info@Stagewood.com.

      We currently do not collect household data. If we receive a Right to Know or Right to Delete request submitted by all members of a household, we will individually respond to each request. We will not be able to comply with any request by a member of a household under the age of thirteen (13), as we do not collect personal information from any person under the age of thirteen (13).

      We will respond to your request within forty-five (45) days after receipt of a Verifiable Consumer Request for a period covering twelve (12) months and for no more than twice in a twelve-month period.  Tyket reserves the right to extend the response time by an additional forty-five (45) days when reasonably necessary and provided consumer notification of the extension is made within the first forty-five (45) days.

      Direct marketing by third parties.  Tyket does not disclose personal information to third parties for their own direct marketing purposes unless you first affirmatively agree to that disclosure, such as in the context of our rewards program.  However, California residents additionally have the right to request information regarding such practices under California’s “Shine the Light” law.  If you are a California resident and would like to inquire further, please email info@stagewood.com.

      F.  Notice of Right to Opt-Out

      We do not sell your personal information.  If you wish to opt out of our sharing of the limited data that is gathered when you visit our Services for purposes of targeted digital advertising, as described in Section 10(d) and elsewhere in this Privacy Policy, we encourage you to visit the Network Advertising Initiative and/or the Digital Advertising Alliance’s Self-Regulatory Program for Online Behavioral Advertising  for more information about opting out of seeing targeted digital advertisements.

      G.  Notice of Financial Incentives

      Tyket may offer discounts on products and services – including those offered by Tyket, its affiliates, or its third party business partners – by joining our rewards program, email subscription lists, or other promotions. The availability of these promotions to you at any given time will vary.  If and when we offer such programs, we may ask for your personal information (such as your email address) as a prerequisite to your participation in the promotion.

      The promotions that may be available to you are:

      • TykChase Rewards Program. When you join our TykChase Rewards Program, we may present you with special offers in the form of free or discounted events, products, or other services, or via sweepstakes, contests, or giveaways.  Many of these offers may be redeemable with Tyk Points, which are earned through various activities on our Services.  In order to participate in this program, you must sign up for the TykChase rewards Program in Tyket and provide your name, email address, age, gender, address, and entertainment interests.
      • Email newsletter. When you subscribe to the email newsletters of Tyket or its affiliates, we may offer you special offers in the form of free or discounted products and announcements of sweepstakes, contests, and giveaways.  In order to participate in the email newsletter, you must provide a valid email address. 

      You may opt-in to the above promotions by visiting our Services.  You may also withdraw from these promotions at any time by contacting us at info@stagewood.com

      The value we place on the personal information that we collect in connection with these promotions is calculated by determining the approximate additional spending per promotion participant, compared to individuals for whom we do not have email addresses, shopping history and preferences, or other collected information.

      11.  European Privacy Notice

      For the purposes of this European Privacy Notice, “personal data” means any information relating to an identified or identifiable natural person. 

      We rely on one or more legal bases to process your personal data under applicable law.  We may process personal data: (i) as necessary to perform our contractual obligations to you, including, but not limited to, those obligations in our Terms of Service; (ii) as necessary to pursue our legitimate interests as further detailed below; (iii) as necessary for our compliance with our legal obligation such as a request or order from courts, law enforcement or other government authorities; and/or (iv) with your consent, including to send you marketing email messages and other information that may be of interest to you. 

      Legitimate business interests.  We may collect, process, and maintain personal data to pursue the legitimate business interests outlined below.  To determine these legitimate interests, we balance our legitimate interests against the legitimate interests and rights of you and others.

We may also use personal data to understand our user base and the effectiveness of our marketing.  This processing is done pursuant to our legitimate interest in undertaking marketing activities to offer products or services that may be of interest to you.  We may also share personal data with our trusted third party business partners consistent with your enrollment in our rewards program.

      • Right to access. You have the right to request confirmation of whether Tyket processes personal data relating to you, and if so, to request a copy of that personal data.

      a.  Your Nevada Privacy Rights

      Nevada residents have the right to request to opt out of any sale of their personal information under Nevada SB 220.  We do not currently sell personal information under Nevada law; however, you may still request to opt out of the future sale of your personal information.  If you are a Nevada resident and would like to make such a request, please submit a written request written request to info@Stagewood.com. You must include in your email or mail request your full name, email address and postal address so that we can verify your Nevada residence and respond.  In the event we begin to sell personal information after the receipt of your request, we will make reasonable efforts to comply with your request as to your personal information.
